Mediation is a voluntary and private dispute resolution process in which a neutral person, the mediator, helps the parties to reach their own negotiated settlement agreement. The mediator has no power to impose a settlement. The function and role of the mediator is to overcome any impasse and encourage the parties to reach an amicable settlement.
In commercial disputes, deadlock and impasse in dispute resolution often occurs due to either a lack of trust in the other party's integrity or a genuine difference of opinion regarding the facts of the case or the likely outcome if it went to court. In such cases, the mediator serves as a go-between, facilitating communication by removing emotional elements and helping the parties concentrate on their core objectives. The mediator's role is to encourage the parties to reach their own agreement rather than having a solution imposed on them.
